By accessing or using Forgift & Forget™ (the “Service”), you agree to these Terms of Service. Do not use the Service if you do not agree. We may change these terms at any time. Continuing to use the Service means you accept those changes.
2. Who can use the Service
You must be at least 18 years old to use the Service. By using it, you confirm that you meet this age requirement and have the legal capacity to agree to these terms.

When you create an account, you agree to:

- Accept responsibility for all activities under your account

4. Cost to use
Forgift & Forget is free to use. There are no subscription tiers, premium features or transaction fees on suggestions. We earn revenue from affiliate commissions when you buy gifts through our recommendations, and from our flower-ordering service.
5. Affiliate commissions
As an Amazon Associate, Forgift & Forget™ earns from qualifying purchases. We also participate in other retailers’ affiliate programs. If you buy through our product links, we may earn a commission at no extra cost to you. These commissions support the Service. Our AI bases recommendations on suitability for your recipient, not on commission rates.
6. AI gift suggestions
Our AI suggests gifts using the recipient information you provide. We aim to make these suggestions helpful and appropriate. The following limits apply:

- AI suggestions are recommendations only, not guarantees of recipient satisfaction
- Product availability, prices, and specifications may change
- We are not responsible for the quality of products purchased from third-party retailers
- You are responsible for verifying that gifts are appropriate for your recipients
- AI recommendations may occasionally be inaccurate or unsuitable
7. Intellectual property
Forgift & Forget™ owns the Service’s content, features and functionality. International copyright, trademark and other intellectual property laws protect them.

- You may not copy, modify, or distribute our content without permission
- User-generated content (recipient profiles, notes) remains your property
- By using the Service, you grant us a license to use your content to provide the Service
8. Prohibited conduct
You agree not to:
- Use the Service for any illegal purpose
- Attempt to access other users' accounts or data
- Interfere with or disrupt the Service
- Use automated systems to access the Service without permission
- Upload malicious code or content
- Harass, abuse, or harm others through the Service
- Violate any applicable laws or regulations
9. Limits on liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the Service in the past 12 months

10. Ending your access

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.

We may change these terms at any time. We will communicate material changes by email or a prominent notice on the Service. Continuing to use the Service after a change means you accept the updated terms.
